Welcome to Equippedly. These Terms & Conditions ("Terms") explain the rules for using our website, purchasing products, designing personalized padel rackets, and requesting custom manufacturing services. Please read them before placing an order or accepting a quotation.
These Terms should be read together with the product description, checkout information, any accepted written quotation, our Privacy Policy, and our Returns & Refunds and Shipping & Delivery policies where applicable. Nothing in these Terms limits rights that cannot lawfully be limited under applicable consumer protection law.
1. WHO WE ARE
Equippedly Ltd — United Kingdom Registered address: Office 1496 85 Dunstall Hill, Wolverhampton, United Kingdom, WV6 0SR Company registration number: 17362794 Email: info@equippedly.co.uk
Equippedly Pvt Ltd — Pakistan Manufacturing and production operations: Sialkot, Pakistan Full registered address: [Verify before publication]
Unless clearly stated otherwise at checkout or in an accepted quotation, Equippedly Ltd is the intended seller for purchases made through the Equippedly online store. Equippedly Pvt Ltd may support artwork preparation, manufacturing, quality control and fulfilment. The precise contracting entity must be confirmed in the checkout, invoice or applicable quotation.
2. SCOPE AND DEFINITIONS
These Terms apply to visitors, account holders and customers using our website or purchasing from Equippedly.
A Consumer is a person purchasing wholly or mainly outside their trade, business, craft or profession. A Business Customer is a person or organization purchasing for commercial purposes. Some provisions expressly distinguish between Consumers and Business Customers.
A Personalized Product means an item genuinely made to a customer's individual specifications or clearly personalized, as determined under applicable law. Choosing among ordinary stock options does not necessarily make a product a Personalized Product.
Where a separately accepted Business quotation or signed agreement deals with specific technical or commercial matters, its agreed project-specific terms take priority to the extent permitted by law. However, our full-refund promise before final artwork approval in Section 13.1 applies to all product orders requiring that approval, including Business orders, and is not displaced by a general deposit or cancellation clause. Mandatory consumer protections always take priority.
3. WEBSITE USE AND CUSTOMER ACCOUNTS
You agree to provide accurate and reasonably complete information when placing orders, creating accounts or making enquiries. You are responsible for protecting your account credentials and notifying us if you believe your account has been accessed without authorization.
Do not misuse the website, interfere with its security or upload unlawful, harmful or malicious material. We may take proportionate steps to restrict misuse, without affecting any rights relating to orders already accepted.
If you are purchasing on behalf of a company or organization, you confirm that you are authorized to do so.
4. PRODUCT INFORMATION AND SPECIFICATIONS
We aim to describe our products accurately, including available racket models, shapes, surface materials such as Glass Fiber, 3K, 12K and 18K Carbon, EVA options, finishes and customization choices.
Product images, photographs and digital previews may show appearance under particular lighting or display conditions. Minor non-material variations in shade, visible weave, texture or hand-finished details may occur. This does not permit us to deliver goods that materially differ from the agreed description, approved specifications or applicable quality standards.
Any stated weight, balance or dimensional tolerance must be identified in the relevant product listing, approved specification or written quotation. We do not impose an undisclosed blanket tolerance through these Terms.
If an option is unavailable or a technical change is necessary, we will contact you where the change is material and obtain any required agreement before proceeding.
5. 3D RACKET DESIGNER AND PERSONALIZATION
Our 3D Racket Designer allows customers to select eligible racket variants and personalize supported design areas with artwork, text, colours and other available options. The preview is a design aid, not a guarantee that every on-screen pixel will reproduce exactly in physical production.
Actual output depends on the approved artwork, materials, print processes and agreed manufacturing specifications. We will not treat significant deviations from the agreed design as automatically acceptable merely because a preview is illustrative.
Please review your selections before checkout. Some draft settings or customization information may be stored in your browser; such drafts are not orders until an order is submitted and accepted.
We may contact you if artwork quality, production constraints, permissions or technical issues require clarification before production.
6. CUSTOMER ARTWORK AND INTELLECTUAL PROPERTY
You retain any intellectual property rights you lawfully own in artwork, photographs, logos, text and designs that you provide to us. Supplying artwork does not transfer its ownership to Equippedly.
By submitting artwork, you confirm that you own it or have obtained the licences, permissions and other rights needed for its proposed use, including where it contains a third party's trademark, photograph, name or likeness.
You grant Equippedly Ltd, Equippedly Pvt Ltd and authorized service providers a limited, non-exclusive permission to receive, review, process, resize or adapt files for printing, prepare digital proofs, reproduce and apply the artwork to manufacture your order, and provide related customer support. We do not acquire ownership of the artwork through that permission.
We may decline to reproduce artwork where we reasonably believe it violates applicable law or another person's intellectual property or other rights, or contains unlawful, discriminatory or seriously offensive material. We will explain relevant concerns where reasonably possible. If an order requiring proof approval cannot proceed and the customer has not yet approved the final artwork proof, the full-refund commitment in Section 13.1 applies. Other mandatory rights remain unaffected.
We will not use customer-supplied artwork in public promotions or a portfolio without separate permission or another applicable lawful basis. The handling of personal information contained in artwork is explained in our Privacy Policy.
7. FINAL ARTWORK PROOFS, APPROVAL AND REVISIONS
7.1 Final proof before production
For personalized orders that require artwork or production-file approval, we will provide a digital final artwork proof (or an equivalent final specification document) through the agreed communication channel before manufacture begins. The proof should show the design and specifications agreed for production as clearly as reasonably practicable.
We will not start manufacturing such an order until the customer has expressly approved its final artwork proof or final production specification. Silence, a failure to respond, payment alone or a saved 3D preview will not count as approval. If the customer does not respond, the order remains on hold and its expected production schedule may be delayed.
7.2 Customer review and recording approval
Please review names, spelling, logos, colours, artwork position, materials, quantities and any other agreed specifications carefully before giving approval. Approval may be provided by a clear written response or an authorized approval control, if that feature is available. We may retain the final proof version and a record of the approval to avoid misunderstandings.
If a post-approval technical check reveals a material difference between the approved proof and the production template, we will explain the change and obtain renewed approval before printing or manufacturing to the changed design.
7.3 Corrections and design changes
We will correct mistakes or discrepancies in a proof that fail to reflect the already agreed design or specification without additional charge. New creative concepts, substantial redesigns or requests outside the original instructions may require a separate quotation and the customer's advance agreement before additional work is undertaken.
Any such additional work does not reduce the customer's full refund of amounts paid for the product order if they cancel before final artwork approval under Section 13.1. A genuinely separate creative service, if offered, must be clearly identified, priced and agreed separately, and its legal cancellation rights will be assessed independently.
7.4 Changes after approval
Once the final artwork or production proof has been expressly approved, our pre-approval full-refund promise ends. For genuinely personalized racket orders, we do not offer voluntary change-of-mind cancellations, returns, exchanges or refunds after final approval where applicable law permits. This applies even if manufacturing has not yet physically begun; however, if you contact us promptly, we may consider a change or cancellation as an exceptional goodwill request at our discretion and subject to applicable law. No goodwill exception is guaranteed. We will not refuse a cancellation or remedy where the law requires one, including for non-conforming goods, failure to deliver or other legally protected circumstances.
8. PLACING ORDERS, QUOTATIONS AND CONTRACT FORMATION
You should have an opportunity to review the selected racket, its customization, quantities, total price, taxes, delivery charges and essential terms before submitting an order. A button or other checkout control should make any obligation to pay clear.
For online orders, we send an acknowledgement or confirmation through our order process. An automated acknowledgement means that an order request was received; it does not, by itself, approve artwork for production. A binding sales contract forms when we accept the order, as communicated through the applicable order-confirmation process. Any final proof approval needed before manufacture is a separate step.
We may contact you to clarify technical feasibility or an apparent error before an order is accepted. After a consumer contract is formed, its agreed price or key specifications will not be changed unilaterally except as permitted by law and with any required consent.
A Business quotation request, free design enquiry, saved 3D configuration or incomplete checkout is not, on its own, an accepted product order. Business orders become binding in accordance with an accepted quotation or other written agreement.
Acceptance of Terms and confirmation: Before a purchase is completed, we present the applicable Terms for review and acceptance in the manner required by law. We provide the necessary contract information in a form the customer can save or retain and record the accepted Terms version and acceptance time in the associated order information.
9. PRICES, CURRENCIES, TAXES AND CHARGES
Prices and currencies depend on the selected website market, the product, chosen configuration and applicable checkout settings. The total payable amount and any additional fees or surcharges must be made clear before purchase, including applicable taxes and shipping costs where required by law.
A displayed "from" price, where used, is an indicative starting price for the material, variant or quantity specifically identified with that price; it is not a promise that all configurations or quantities cost the same. The applicable final order total is confirmed at checkout or in an accepted written quotation. Additional customization charges will not be imposed after agreement without an appropriate legal basis and any required consent.
Where duties, import taxes or customs brokerage fees are not included, we will explain the relevant arrangements before ordering to the extent required by law. DDP (Delivered Duty Paid) applies only where expressly confirmed in the order or quotation; it is not included for every international shipment.
Business quotations will identify the applicable unit prices, quantities, currency, validity, packaging, taxes and freight arrangements. Catalogue changes do not automatically change the price of a contract already accepted. Promotions and discounts will be subject to conditions clearly stated with the offer.
10. PAYMENTS, DEPOSITS AND REFUNDS
Available payment methods are those displayed at checkout or stated in an accepted quotation. Where enabled, online payments are processed using Stripe and any other providers expressly offered at checkout. Other payment arrangements may be offered for particular Business orders when agreed in writing.
We will not ask customers to pay through an unverified payment link or bank account. Contact us through info@equippedly.co.uk if payment instructions appear suspicious.
Any deposit, staged payment or balance deadline for a Business order must be disclosed in the relevant quotation or agreement. For an order requiring final production-artwork approval, payments already received for that product order, including deposits and agreed product-order charges, will be refunded in full when the customer cancels before giving that final approval, under Section 13.1. We do not withhold a design-setup fee or retain a non-refundable deposit from that pre-approval refund.
Following a qualifying pre-approval cancellation, we will initiate reimbursement without undue delay, aiming to do so within 14 days after receiving the clear cancellation request, or sooner if applicable law requires. The refund will normally use the original payment method unless otherwise agreed; the customer's financial institution or payment provider may affect when cleared funds appear.
Refunds required for other lawful cancellations or defective goods will follow the applicable rules. If a payment is unsuccessful, we may pause fulfilment and contact you to resolve the issue, without removing rights already arising under an existing contract.
11. PRODUCTION, APPROVAL DEPENDENCIES AND LEAD TIMES
For orders that require final artwork or production-specification sign-off, production will not begin before express final approval under Section 7. Production may also depend on complete technical specifications and satisfaction of agreed payment conditions.
Any production or delivery estimate shown in a listing, checkout, quotation or order confirmation is based on the relevant product and order circumstances. If an approximate turnaround, such as around four weeks following final artwork approval, is communicated for a particular racket order, it is an estimate rather than a guarantee unless we expressly agree a binding delivery date.
Delays in submitting artwork or approving a proof may postpone the estimated schedule. If we anticipate a material delay after order acceptance, we will contact the customer and respect any statutory rights to delivery, cancellation or other remedies.
Samples and Business bulk orders may have different lead times agreed in writing. We do not promise a universal production or shipping time for every product, destination or order quantity.
12. SHIPPING, DELIVERY AND INTERNATIONAL ORDERS
Shipping options, charges and expected delivery arrangements will be displayed at checkout or agreed in writing. Deliveries may involve third-party couriers and customs authorities.
For Consumers, responsibility for goods in transit and delivery rights remain subject to applicable consumer law. In particular, we will not shift transit risk to a Consumer earlier than applicable law permits merely by handing goods to a courier we arranged.
Unless another lawful delivery period has been agreed, applicable UK consumer rules generally require delivery without undue delay and within 30 days of contract formation. If there is a material delay, we will respect the remedies available under applicable law.
For Business orders, allocation of freight costs, import duties, customs responsibilities and risk will follow the expressly agreed shipping terms or Incoterms, where used.
Customers should provide an accurate delivery address and cooperate with reasonable delivery arrangements. Our Shipping & Delivery Policy contains further operational details.
13. CANCELLATIONS, WITHDRAWAL RIGHTS AND RETURNS
13.1 Equippedly's Full-Refund Promise Before Final Artwork Approval (Option A)
For an order that requires a final artwork proof or final production-specification approval, the customer may voluntarily cancel at any time before giving that final approval by clearly notifying us at info@equippedly.co.uk.
We will refund 100% of the amounts paid to Equippedly for that product order, including any product-order deposit, manufacturing prepayment, artwork setup included in the order and any delivery charge paid for that unshipped order. We will not deduct a design-preparation charge, payment-processing charge or cancellation penalty from this refund. The commitment applies to qualifying personalized consumer racket orders and Business manufacturing product orders that require final proof approval.
This is an additional Equippedly customer-service commitment; it applies even where a genuinely personalized product would otherwise fall outside the ordinary statutory change-of-mind cancellation right. Applicable legal rights may provide further or different protections and always take priority where required.
The customer need not give a reason. We will confirm the cancellation and initiate reimbursement without undue delay, normally within 14 days after receiving the request, or sooner if required by applicable law. Funds will ordinarily be returned through the original payment method unless otherwise agreed.
If no final proof has yet been issued or the customer has not responded to it, the order has not been finally approved and remains eligible for this full refund. A preliminary visualization, saved 3D draft, deposit payment or ordinary order acknowledgement is not the final approval.
If a technically revised proof requires fresh approval under Section 7.2, we will not manufacture the revised design without that approval. Any rights to cancel or obtain a refund resulting from the proposed changes or our failure to deliver the agreed goods remain unaffected.
13.2 After Final Approval: Production and Voluntary Changes
Once the customer expressly approves the final artwork or production proof, the voluntary 100% pre-approval refund promise in Section 13.1 ends. For a racket genuinely made to the customer's specifications or clearly personalized, Equippedly does not offer voluntary cancellations, returns, exchanges or refunds due solely to a change of mind after that approval, where applicable law permits. This policy applies whether manufacturing has started or is only scheduled.
If you contact us immediately after approval and production has not started, we may, at our discretion, consider a voluntary change or cancellation as a goodwill exception. This is not an automatic entitlement or a promise of a refund. We will explain any proposed arrangement before proceeding. If a mandatory legal cancellation or refund right applies, it takes priority regardless of the approval or production status.
This no-voluntary-refund rule is not a blanket rule for all configurator purchases. Standard or non-personalized rackets may remain eligible for statutory withdrawal rights under Section 13.3. Artwork approval never takes away remedies for a faulty, misdescribed or incorrectly made racket, non-delivery or any other breach for which applicable law provides a remedy (Sections 13.5 and 14).
13.3 Ordinary Withdrawal Rights for Eligible Non-Personalized Goods
For eligible Consumers buying standard, non-personalized products at a distance, UK and EU rules may provide a 14-day change-of-mind period after delivery (subject to the rules applying to the customer, product and transaction). The customer may notify us through a clear email or use Annex A.
Where a lawful withdrawal right applies, we will comply with applicable provisions governing the return of goods, reimbursement timing, standard outward delivery costs, any properly disclosed return-shipping charges and any lawful deductions for excessive handling. Different jurisdictions may provide additional rights.
13.4 Exception for Genuinely Personalized Goods
UK and EU rules may exclude the ordinary statutory change-of-mind withdrawal right for goods made to the customer's specifications or clearly personalized, where that exception lawfully applies and has been properly disclosed before contracting. For qualifying goods, Equippedly does not offer additional voluntary change-of-mind returns, exchanges or refunds after final artwork/proof approval, subject always to applicable law and Section 13.2.
Not every purchase of an existing racket variant, material or stock colour automatically qualifies as a personalized product. Whether the exception applies depends on the real facts of the order, including the individualized artwork or production requested. Customers retain any ordinary withdrawal rights that apply to non-personalized purchases.
Importantly, Section 13.1 still gives eligible orders our separate 100% full-refund promise before final proof approval even if a statutory change-of-mind exception could apply.
13.5 Faults, Wrong Goods and Other Legal Rights
Neither artwork approval nor a change-of-mind exception removes statutory rights if goods are defective, misdescribed, materially different from approved specifications, or delivered in breach of applicable law. Section 14 describes how to raise those issues.
13.6 How to Cancel or Request a Return
Email info@equippedly.co.uk with the order number, your contact details and a clear request to cancel or return. We will acknowledge the request and provide any necessary instructions. A customer does not need to use a specific cancellation form for a valid clear cancellation notice.
Do not return products to the registered office without receiving return instructions. See the separate Returns & Refunds Policy, which must reflect these same rights and commitments.
14. INCORRECT, DAMAGED OR FAULTY PRODUCTS
We aim to supply goods that conform to their description, the agreed specifications and applicable quality standards.
If your racket arrives damaged, differs materially from your agreed order or develops a defect, contact info@equippedly.co.uk with your order details and an explanation. Photographs can help us investigate, but we will not impose an arbitrary short notification deadline that removes statutory rights.
Available remedies depend on the circumstances and applicable law and may include repair, replacement, price reduction or refund. Any applicable statutory guarantee or remedy remains available even for genuinely personalized products.
Ordinary wear and tear, misuse or damage occurring after delivery will be assessed in light of the product, evidence and applicable law. We will not use those categories to deny a valid manufacturing-defect claim automatically.
Nothing in these Terms excludes or restricts a Consumer's mandatory statutory rights.
15. BUSINESS AND BULK MANUFACTURING ORDERS
Business Customers may request OEM/ODM quotations for custom padel rackets, branding and associated manufacturing services. A quotation request does not itself oblige either party to enter a manufacturing contract. No universal Business minimum quantity or price is imposed by these Terms: the minimum, unit prices and other commercial details must be shown in the particular product offer or quotation.
A Business quotation or agreement should identify, where relevant:
- Product models, shapes, materials, core construction and technical specifications
- Custom artwork, screen-printing or other approved branding method and proof requirements
- Quantities, any agreed minimum order quantity, price currency and quotation validity
- Packaging, samples, prototypes and required approvals
- Payment conditions, deposits and balance milestones
- Weight, balance, construction and agreed quality tolerances
- Production schedule, inspection and defect-reporting arrangements
- Shipping method, Incoterms (if used), duties, taxes and customs responsibility
- Any separately agreed services and documented project-specific terms
The Business contract forms according to the accepted quotation or other written agreement. The customer is responsible for reviewing the final production artwork and technical specifications, and we will not manufacture an order requiring approval before that approval is expressly provided. Technical issues identified after approval that materially change the agreed proof must be brought back to the customer for a new decision.
Option A applies by default to Business product orders requiring final artwork approval: if the customer cancels before expressly approving the final production proof, we refund all amounts paid to Equippedly for that product order, including deposits and product-order design preparation, without deductions as stated in Section 13.1. General references to incurred costs, deposits or cancellation fees elsewhere in these Terms must not be used to override that pre-approval promise.
Following final approval, no voluntary change-of-mind cancellation, return, exchange or refund is offered on genuinely bespoke Business racket orders, to the extent permitted by the agreed contract and applicable law, whether or not manufacturing has started. We may consider an early post-approval goodwill request, without guaranteeing its acceptance. This limitation does not apply to legally required remedies for breach, defects, incorrect specifications or failure to deliver. Any mutually agreed redesign or change must be documented and any added charge approved in advance.
Consumer-specific legal rights do not ordinarily apply to purchases genuinely made for business purposes. Separately commissioned services, if any, must be clearly described in advance as separate contracts rather than hidden deductions from a refundable product order.
16. WEBSITE AND EQUIPPEDLY BRAND INTELLECTUAL PROPERTY
The Equippedly name, website text, original graphics, product imagery, software interfaces and other content may be protected by intellectual property laws and belong to Equippedly or their respective licensors.
You may use the website for ordinary browsing, purchasing and authorized design activities. You may not copy, redistribute or commercially exploit our protected content without permission, except as permitted by law.
Your uploaded artwork remains subject to the ownership and limited-use provisions in Section 6.
17. PRIVACY AND COOKIES
We handle personal information as described in our Privacy Policy. Our Cookie Policy explains relevant cookies and similar technologies and how preferences may be managed where available.
Our website may use necessary technical storage to operate shopping and design functions. Use of optional analytics or marketing technologies is subject to applicable consent and privacy requirements.
18. WEBSITE AVAILABILITY AND THIRD-PARTY SERVICES
We aim to keep the website and customization tools available and accurate, but maintenance, connectivity problems or third-party failures may occasionally affect access.
Third-party payment, delivery or linked services may have their own terms and privacy notices. Their separate terms do not remove our obligations to customers under applicable law.
If a technical problem materially affects an accepted order, please contact us so we can arrange an appropriate solution.
19. LIABILITY AND NON-EXCLUDABLE RIGHTS
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or limited.
Nothing in these Terms removes mandatory Consumer rights concerning faulty, misdescribed or non-conforming goods, delivery or lawful cancellations.
For Business Customers only, any specific, lawful allocation or limitation of commercial liability must be set out in the applicable agreement and will be subject to relevant legal controls. These general Terms do not impose an unagreed universal liability cap.
20. EVENTS OUTSIDE REASONABLE CONTROL
Events outside a party's reasonable control may affect manufacturing or delivery. If this happens, we will communicate relevant delays and take reasonable steps to reduce disruption.
This section does not override any legal rights to cancellation, refund, delivery or other remedies that remain available under applicable law.
21. COMPLAINTS AND DISPUTES
If there is a problem with your order or experience, please contact info@equippedly.co.uk with your name, order or quotation reference and details of the issue. We will investigate and seek a fair resolution.
Where a specific complaint procedure, dispute-resolution arrangement or regulator disclosure is required by applicable law, it will be provided as appropriate. [Verify any legally required ADR information before publication.]
22. GOVERNING LAW
To the extent legally permitted, these Terms are governed by the laws of England and Wales.
If you are a Consumer living outside England and Wales, this choice does not deprive you of any mandatory consumer protections or rights to bring proceedings in a court that applicable law gives you in your country of residence.
For Business Customers, a separately agreed written contract may specify the governing law and dispute forum.
23. CHANGES TO THESE TERMS AND ORDER RECORDS
We may update these Terms for future transactions when our services, systems or legal obligations change. We will not unilaterally substitute a later version to a previously accepted order to the customer's disadvantage without an appropriate lawful basis and agreement.
The version applicable to a confirmed order is made available in a format the customer can save or print, along with the necessary order confirmation. We maintain the accepted version and acceptance time in the associated order record.
The publication date and version identifier will be updated when an amended version is approved and published.
